Member Sublease Agreement

This sublease agreement is for scheduled use of the meeting space at 1840 Alcatraz Avenue in Berkeley, CA 94703.
  • This Sublease Agreement will be valid until 6 months from today's date, at which time it can be renewed for another 6 months for $35.
  • In this agreement, "Member" refers to you, "Directors" refers to Mike McGarry & Mich'ael Bedar, and "parties" refers to both of us.
  • Member will pay rental fee at rate of $17/hour for Individual Session Room & $22/hour for Group/Workshop Room, unless a monthly use agreement is selected.
  • Select "as needed" if you a unsure of how many hours you will use weekly/monthly. Select a monthly plan if you would like to commit to paying for the space at least that many hours per month for a discounted rate.
  • Member will pay rent on a monthly basis no later than the last day of the month. Member will pay a $10 late fee if rent is received after the 1st of the month. Rent check are made payable to "Mike McGarry" and left in the appropriate location at the Collective. Rent can also be paid paid by credit card online at http://healingcollective.org/pay-online/. Thank you for keeping track of your hours and paying your rent on time.
  • Membership will be active once member has paid the $50 initial membership fee and the $25 refundable security/key deposit. Membership is renewed every 6 months at $35. If membership is not renewed and keys are returned, $25 deposit will be returned. Security/key deposit may not be used as last month or days rent. Member agrees not to reproduce keys. A $10 fee is charged for replacement keys.
  • Our cancellation policy is designed to support flexibility for collective members renting space, while still maintaining EBHC’s needs for sustainability. All cancellations must be submitted in writing to info@healingcollective.org. Floating Renters may cancel with 48 notice prior to any session, full rent is due with less than 48 hours notice. Monthly renters may cancel their monthly rent agreement with 14 days notice, full rent is due with less than 14 days notice. Workshops may cancel with 30 days notice, full rent is due with less than 30 days notice.
  • Member will use the Meeting Space for professional use only. Member will not use the Meeting Space for private or personal use, and will not use the Meeting Space for any overnight programs or guest(s).
  • Member and his/her clients may use restroom and kitchen facilities on the ground floor. Member agrees to care for these spaces with diligence and respect, leaving them clean and tidy. Member agrees to report any damages, problems or facility malfunctions to the Director within 24 hours of the issue’s occurrence.
  • Member expressly and voluntarily agrees to assume FULL responsibility for any and all liability with the individuals and clients s/he serves and the materials utilized for all activities and services performed in the Meeting Space. Member understands and voluntarily agrees that Director and EBHC assume no legal responsibility or liability for the healing work or other business exchanges Member has with clients. Further, Member understands that the nature of the business relationship with Director and EBHC is strictly one of renting space. Member is strongly advised to obtain insurance to cover any legal or other liability Member may incur. UNDER NO CIRCUMSTANCES SHALL DIRECTOR’S OR EBHC’S TOTAL LIABILITY UNDER ANY CAUSE OF ACTION ARISING OUT OF THIS AGREEMENT EXCEED THE TOTAL AMOUNT PAID BY MEMBER TO DIRECTOR IN THE SIX MONTHS PRECEDING ANY SUCH ACTION.
  • Smoking or incense (including sage or burning of anything) is not allowed in the Meeting Space. Supervised use of unscented candles only is permitted. For safety, please respect these guidelines.
  • In addition to the provisions of this Sublease Agreement, the Member agrees to be bound by all the conditions of the Master Lease between Director and the landlord, Jim Novosel. Available for download below. If the Director terminates the Master lease, Member will be given 30 days notice, but if the Landlord terminates the Master Lease for any reason, Member understands the agreement will terminate effective the same date.
  • Member acknowledges that s/he has examined the Meeting Space and that it is in good condition. Upon the termination of this Sublease Agreement for any cause, Member will leave the Meeting Space in its original good condition, except for reasonable wear and tear. Member is responsible for the repair of any damage resulting from the act or neglect of Member or those persons who are invitees/clients of the Member.
  • Member may not lease, sublease, or assign the Meeting Space without the prior written consent of the Director. This is a non-exclusive arrangement, Member may sublease other space and Director my sublease this space to others.
  • In the event of a dispute or disagreement between Parties, both agree to engage in community mediation to attempt to resolve the conflict. If mediation is unsuccessful in resolving differences, both parties agree to arbitration for dispute resolution in Alameda County, each party shall bear their own costs.
  • There is a $50 initial membership fee (+ $25 refundable key deposit), renewed every 6 months at $35. Pay your membership fees by credit card here.
